irs tax lien-help-payment plans????
I got paper work that says we have a repayment plan in place, but then I got a lien notice. I am never going to be able to pay this back as they keep adding penalties. Help!

Answer:

Jenise, You have 3 different issues here.

1. The payment plan stands alone from the lien on your home. If you have it in place and can afford the payment them continue on.

2. If you owe over (I think the number is 10K) then the IRS has the right to file their lien to perfect their interest. Half the time they do the other half they don't. Once you do have one on your home you are bombarded by companies like myself with mail offering to help you.Many promising to do an Offer in Compromise (OIC) to reduce the above taxes.

Most want 3,200 down to help you, be very carefull prior to doing anything. Your lien is public knowledge so companies buy lists and write letters. Remember everyone can do an offer but the vast majority are rejected because they are frivolous.

Prior to giving anyone your money for the OIC make sure you qualify, because you won't get a refund.

3. You inability to pay. The one and only way to reduce any amount owed is through an Offer in Compromise program with the IRS. If you go my 7 minute video called The Tax Freedom ToolBox on the home page of this site...and take the test drive; I tell you if you are a candidate or not and I give you options as well as a self-calculating form at the bottom to see if this may or may not be an option for you.I encourage everyone who owes to take the Test Drive.> If you are close or even if you are not please email me your outcome and I will see if you are accurate and possible in a hardship, need a longer payment plan, are an offer candidate etc. you have options.

personal & payroll taxes-help
the state of Calif sent me a letter stating I owe 115,000 to the state and more personally. I have only had one employee 5 years ago and I ampositive I filed the forms and paid with them. I even remember doing the W2 that year. I havent filed since then because my son got cancer and passed away last year and it took all I had to get up and take care of him. Now I am healing and need to heal my life but 115,000 total when I was just a little 2 man remodeling team, I might go back to bed. Ben

Ben, GET UP AND GET OUT OF BED. If I am correct and I think I am we can fix this and I won't even charge you, just to begin your life anew. So pick up the phone NOW.

My bet is that you don't owe much of anything. I know the state of Ca.well. When you filed your last Quarter payroll reports if you didnt mark final on the form they have just gone on an assumed you have had employees. You never told them other wise, did you? So they just take your averages time the last 5 years and that is where the number comes from.

Individually, they do the same.

In my 25 years I have run into this scenario hundreds of times. So, if you never had an employee that you didn't file and or pay for...you just have to write a letter or better yet pick up the phone and just tell them your story. Tell them why, you have a darn good reason and they will move everything back to zero.

I work in all states with my clients but the state of Calif. gets your attention with arbitrary assessments and BOOM you are at attention. If you get an agent hard to work with just email me. the state of kansas sent me a letter stating to avoid publication my property taxes needed to be paid by july 31 what does this mean?

Answer:

Dear Barbara, I can't help you on property taxes, it isn't my area of expertise. I only work with state income taxes and state payroll taxes. The IRS as well, but not property taxes. Lesley

IRA distribution -audit - help

Hardship ?'s on 7-29-2009
We took 40000 in 2006 from IRA. They have turned that into a 10,000 bill that we received yesterday. They are not allowing the 22,000 for my sons college expenses and my 18,000 for medical and living being out of work. The penalties and interest bring the 4000 to 10000. Anything we can do???

Answer:

I have given the answer to this person off-line due to the many complexities in his audit. We worked out a plan of attack and he will get back with me next week to see if it was successful.

short sale
What are the tax ramifications of a short sale on an investment property? (originally it was my primary residence but I couldn't get it sold and have since bought another home) Renters of the propery left it in bad shape and owing too many months rent. Offer has been made on it but is only half of what it's owed.

Answer:

Kelli, We have CPA's and tax advisors as well as Tax Attorney's on staff but they don't participate in the free blog for people with serious tax problems.

They worry about wrong advice because of the hundreds to thousands of changing tax laws annually and advising someone wrong and getting sued for it.

This forum is for tax problems and how to solve them once the liability has been assessed. Those laws are very black and white; either you are eligible for an Offer in Compromise or an Innocent Spouse or have a garnishment that needs to be released....these scenarios are based on formulas and forms that don't change or have grey areas....You either fit the profile or you don't.

My job is to make you fit some solution protocal, I work after the fact. A tax planner workes in the current tax arena.

We could prepare the last 8 years tax returns in all states based on past tax laws, but we don't give current tax advice. We leave that to the CPA's. You get the drift, don't you?

If you had a short sale in Georgia in 2007 and owed 32,000 then I could use those figures to give you a road map to settling the liability.

2008 taxes owed to IRS
I owe $6k to IRS for last 2008; will I be able to settle for less than this?

Answer:

Debra, I would like you to go to my web-site here and take the FREE test drive.You will find the option right under my chat buttom. This will tell you in my 7 minute free video if you can possibly pay less. Tell me if you fit the profile for an Offer in Compromise candidate when you complete the form also included after the video.

I have the only educational video with drop down menus and form fill advice pages that go by a page at a time to help you determine your eligibility.

The only way to pay less than what you owe is through this program. This is the absolute only way. If you listen to the 7 minute video, then go to the form fill for estimating you will be very close in the determination of"If you can pay less" than you owe based on if you fit the program and or their formula.

If you don't then you have several other options, a payment plan of 6,000 divided by 60 months would most likely be accepted...I make them daily for people. Or uncollectable if you can't pay for 12 months, based on the same formula I had you put in for the offer, but only using the income expense side of the form. All IRS scenarios are based on formulas, you will either fit it or flunk it.

It doesn't take a financial wizard to deal with them. It is just very frightful and most people choose to ignore uncomfortable situations as long as they possibly can. I hope this helps you, and if you are an offer candidate please blog me back so I can tell you how to proceed. Lesley
